THE EMERGENCY HEALTHCARE BILL FOR THE INCARCERATED
A quick breakdown:
This Bill will be for CDCR to allow hospitals to contact family members of the incarcerated when they are admitted into a health facility, it will allow for CDCR to allow family members to visit their incarcerated loved one in a hospital, and it will remove fees for obtaining medical records for the incarcerated.
Currently: Families are not being notified when their loved ones are hospitalized, families are not able to visit a loved one in hospitals, and incarcerated individuals are being charged fees to request their medical records.
Background info:
Senator Sydney Kamlager introduced a bill on February 16 that would require CDCR to inform persons named in a medical release form of the incarcerated person’s health status within 24 hours of an incarcerated person being hospitalized.
SB 1139 also would require the department to make emergency in-person contact visits and video calls available whenever an incarcerated person is hospitalized or moved to a medical unit within the facility and the incarcerated person is in critical or more serious condition.
The bill would also require CDCR facilities to have a grievance process in place by which an incarcerated person or designated person may file a formal grievance to review the failure of the department to provide health care information to specified persons, to provide notice of an incarcerated person’s hospitalization to specified persons, to provide visitation during hospitalization, or to provide medical care and treatment, as specified.

This bill requires the California Department of Corrections and Rehabilitation (CDCR) to place an incarcerated parent, legal guardian, or caregiver of a minor child in the correctional facility closest to that child’s home. The bill also allows already incarcerated parents to request a transfer to the prison closest to their child’s home.

This bill would require the department to, upon request by a visitor, scan certain documents into the Strategic Offender Management Systems (SOMS), including, among other documents, a birth certificate for a visiting minor, as specified. The bill would require the department to allow a visitor for an in-person visit or an approved family visit to bring certain items for the visit, including, among other things, items for infants and toddlers, as specified.
